These Terms of Service (“Terms”) govern your use of the Sophia Forge website and related online services (“Service”) operated by Jewel Systems (“we,” “us,” or “our”), a company registered in Brazil, operating under the trade name Sophia Foundry.
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. About the Service
Sophia Forge is a game development application created by Sophia Foundry. The Service refers to the Sophia Forge website, including features such as the public roadmap, changelog, bug tracker, and any authenticated features accessible through your account. The Service does not include the Sophia Forge desktop application, which is a separate product governed by its own terms.
2. Eligibility
You must be at least 18 years old to create an account or use the Service. By registering, you confirm that you meet this age requirement.
We do not permit minors to use the Service. We require date-of-birth verification at registration. If we become aware that a user is under 18, we will suspend or delete their account.
3. Your Account
You are responsible for maintaining the security of your account credentials. You agree to provide accurate information during registration and to keep it up to date.
You may delete your account at any time through your account settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy, except where retention is required by law.

4. Acceptable Use
You agree to use the Service in good faith and in compliance with applicable laws. You may not:
- Use the Service for any unlawful purpose

- Use automated tools to scrape, crawl, or extract data from the Service without our written permission
- Impersonate any person or entity
- Upload or transmit malicious code, viruses, or any harmful content
We reserve the right, at our sole discretion, to suspend or terminate accounts that violate these Terms.
5. User Content
You may submit content through the Service, such as bug reports, feature requests, or other contributions (“User Content”).
You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and modify your User Content for the purpose of operating and improving the Service.
You represent that you have the right to submit any User Content you provide, and that it does not infringe any third party's rights.
6. Feedback
Any feedback, suggestions, or ideas you submit to us — whether through the Service, Discord, GitHub, or any other channel — is considered non-confidential and non-proprietary. We may use such feedback without compensation or attribution and without any obligation to you.
7. Intellectual Property
All content, code, design, and branding associated with Sophia Forge and Sophia Foundry are the property of Jewel Systems or its licensors. You may not reproduce, distribute, or create derivative works from any part of the Service without our written permission.
8. Voluntary Contributions (Honor System)
Sophia Forge operates on a voluntary contribution model. The Service is free to use. If you choose to make a voluntary contribution, it is non-refundable and does not entitle you to any additional features, services, or special treatment beyond any recognition we may offer at our discretion (such as a community role).
9. Service Availability and Limitations
We strive to keep the Service available and functioning, but we cannot guarantee uninterrupted or error-free access.
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users in advance of significant changes, but we cannot guarantee prior notice in all circumstances.
We do not warrant that the Service will meet your specific requirements or expectations. You understand that, as a small independent studio, our resources are limited, and we prioritize improvements based on our capacity and judgment.
We do not guarantee response times for support requests.
10. Limitation of Liability
To the extent permitted by applicable law, including the Brazilian Consumer Protection Code (Lei nº 8.078/1990), our liability in connection with the Service is limited as follows:
- We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Service.
- We are not liable for any loss of data, revenue, or business opportunity related to the Service.
- We are not liable for interruptions, errors, or defects in the Service, provided we act in good faith and make reasonable efforts to address known issues.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Brazilian law, including liability for damages caused by willful misconduct or gross negligence.
11. Third-Party Services
The Service may include links to or integrations with third-party services (such as GitHub, Discord, or authentication providers). We are not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is governed by their respective terms.
12. Communications
By creating an account, you agree to receive essential service-related communications from us, including account security notices, Terms of Service updates, and critical announcements. These communications are necessary for the operation of the Service and cannot be opted out of.
We may also send non-essential communications such as product updates or newsletters. You may opt out of non-essential communications at any time through your account settings or by following the unsubscribe instructions in the message.

Your personal data is handled in accordance with our Privacy Policy, which complies with the Brazilian General Data Protection Law (Lei nº 13.709/2018 — LGPD) and the Marco Civil da Internet (Lei nº 12.965/2014).

If you do not agree with the updated Terms, you may stop using the Service and delete your account.

We may suspend or terminate your access to the Service, at our sole discretion, if you violate these Terms, if required by law, or if we discontinue the Service. Where possible, we will provide notice before termination and allow you to export or delete your data.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federative Republic of Brazil.
Any disputes arising from these Terms or your use of the Service shall be submitted to the courts of the Comarca de Caraguatatuba, State of São Paulo, Brazil, without prejudice to any other jurisdiction that may be applicable under Brazilian consumer protection law.
